Vehicle recovery and transport terms and conditions
By placing a booking with us you are deemed to have fully accepted our terms and conditions.
-
We may use third party sub-contractors or agents at any time for any bookings.
-
You must take all precautions for your own safety and that of any occupants of your broken down vehicle at all times.
-
Oxford Breakdown Recovery shall not be liable for loss of or damage to any vehicle prior to loading and after discharge from the transporting vehicle, howsoever such loss or damage arises, except during handling of vehicles held by us.
-
Oxford Breakdown Recovery does not accept any responsibility for the loss of or damage to the contents of any vehicle at any time. It is deemed that the customer has removed all valuable personal belongings and contents from the vehicle before the vehicle is loaded onto our truck or handed over to our driver.
-
Although we will try, we cannot guarantee delivery during business hours. Your vehicle will be delivered as and when it arrives at the delivery address, and it is your responsibility to receive it or arrange someone to receive it on your behalf. Most garages have space to leave any recovered vehicles outside their premises and post the key through the letterbox if they are closed.
-
The confirmation of booking or our acceptance to transport a vehicle does not imply that the vehicle will actually be loaded. Actual loading and/or delivery will depend on any circumstance which may prevent Oxford Breakdown Recovery from reaching the collection point or destination and actually loading/unloading the vehicle. We reserve the right to cancel or delay any shipment without penalty and/or liability. We reserve the right to retain any deposit received and/or charge additional fees if you cancel the booking or there are circumstances beyond our control that prevent us recovering, towing or transporting your vehicle.
-
We do not take any responsibility for any items or goods in your vehicle. You are advised to remove all valuables prior to your vehicle being loaded on our recovery truck. For cross-border recovery, towing and transportation, you must notify us in advance of any items or goods being imported and notify customs to arrange all necessary paperwork in advance; delays will be charged for. By placing the booking you confirm there are no illegal or illicit items in your vehicle and that you remain fully liable for any such item or goods.
Kerbside Collection and Delivery; Access to Private Premises
All quotes are for recovery, loading and unloading from the kerbside on a public road only. If you require us to collect or deliver from or to any private premises, building or land, this must be agreed in advance. By placing a booking, you confirm that all access to and at the premises is suitable for our recovery vehicle. We will not accept any liability for damage to property, grounds, drainage, fences, or any other structures, howsoever caused, if you have requested us to collect or deliver to any off-road or private premises. Access and movement on private land is entirely at your risk and responsibility.
Zero-Tolerance Policy on Staff Abuse
We operate a zero-tolerance policy regarding abuse towards our staff. Any abusive, threatening, or aggressive behaviour towards our staff will result in immediate cancellation of your booking or service without any refund. We reserve the right to refuse service to anyone who breaches this policy.
Payment
All bookings must be paid for prior to or at the time the vehicle is handed over. Accepted methods of payment are BACS bank transfer, card payment over the phone in advance, or cash in advance or at point of collection/delivery. For collection of vehicles outside of Oxfordshire we may require prepayment in full or in part to confirm the booking.
If Oxford Breakdown Recovery is instructed to collect a vehicle on or after any particular day/time, yet are unable to collect the vehicle due to the vehicle being unready at the collection point or funds being uncleared, or any other reason out of our control, then the contract shall be deemed terminated and Oxford Breakdown Recovery shall be entitled to claim full payment for the transportation order.
Oxford Breakdown Recovery reserves the right to charge the customer for any costs incurred by Oxford Breakdown Recovery during the transportation of your vehicle such as congestion charges, toll charges, ferry charges, low emission zone charges etc.
Our driver(s) will wait for a maximum of 30 minutes. If the driver is required to wait any longer, then a waiting charge shall be applied. The charge is currently £60.00 per hour for each driver and truck. Drivers reserve the right to refuse the loading of a vehicle if it is considered by him/her unsafe to do so, for whatever reason; the driver has absolute discretion on the decision.
Insurance and Liability
During our period of responsibility, which is whilst the vehicle is loaded on our truck, all vehicles are covered by our 'Goods In Transit' insurance, a copy of which is available on request. Any additional insurance required for loads in excess of our 'Goods in Transit' insurance will be negotiated and may be invoiced separately.
Where possible, we will make photos and videos of the condition of your vehicle before collection and after delivery to record any visible damage.
Whilst every effort is made to keep to promised delivery schedules, Oxford Breakdown Recovery will not be held responsible for late or failed collections or deliveries due to unforeseen circumstances beyond our control such as road works, traffic delays or accidents, breakdowns or adverse weather conditions etc.
Any damage not notified on the delivery note will not be accepted by us, unless we are notified in writing within 48 hours of the delivery, and the damage can be viewed by us prior to any repairs. Any damage notified to us on the delivery note, estimates must be submitted within 7 days and we reserve the right to claim any replaced part as proof of damage. Oxford Breakdown Recovery will not be held responsible for any damage that cannot be attributable to negligence on behalf of Oxford Breakdown Recovery or their staff, for example Acts of God (storm damage, bird strike, bird droppings, etc.), stone chips, acts of vandalism not preventable by Oxford Breakdown Recovery. Oxford Breakdown Recovery will not provide or be liable to any hire cars, replacement vehicles or compensation whilst the vehicle is being repaired.
Cancellation and Refund Policy
Oxford Breakdown Recovery reserves the right to retain any deposit or payments received in full or in part. We reserve the right to charge the full call out charge or the full cost advised at the time of booking for the specific booking once en route to the location of the vehicle to be transported/recovered, even if the customer decides not to have the vehicle transported or recovered.
No refunds will be given for cancellations made less than 48 hours prior to the agreed transport date if a booking was made in advance. No refunds will be given after the vehicle has been transported. No refunds will be given for any change made by the customer to the collection or delivery address. We reserve the right to retain full payment for any cross-border booking if you cancel.
These terms & conditions may be changed or updated by us without any prior notice.
